Welcome to the Gap Inc. WiFi services, offered at select Gap, Banana Republic, OldNavy, Piperlime and Athleta stores (the "Services") as a service to our customers. Please review the following terms and conditions of use, which govern your use of the Services (the "Agreement").

Your use of the Services constitutes your agreement to follow and be bound by the Agreement. We reserve the right to update or modify this Agreement at any time without prior notice. For this reason, we encourage you to review the Agreement whenever you use any of the Services. If you do not agree to these terms, please do not use the Services.

No Expectation of Privacy or Security

While Gap Inc. may elect to put in place certain security measures, we are under no obligation to use any specific anti-virus, encryption or other security measures and you assume this risk in using the Services. You should utilize additional security measures as you feel are necessary to help ensure secure transmissions. Gap Inc. reserves the right to monitor and store any data traffic on this connection for security, analytics and operational purposes and to terminate any connection at its sole discretion. Accordingly, you should have no expectation of privacy when using the Services.

Data collection and Use

Gap Inc. may require that you submit your email address in order to use the Services. Gap Inc. may use this email address as specified in the Gap Inc. Privacy Policy including to contact you with promotions and offers. Gap Inc. also collects technical information about the device you use to connect to the Services such as device ID, MAC address and other identifiers. Please see the Gap Inc. Privacy Policy for additional information about how we may use and share data collected via the Services.

Prohibited Uses

Use of the Services is voluntary and you may not resell access or otherwise grant access to any party not authorized by Gap Inc. You may not use the Services to commit any unlawful act, violate the rights of any third party or to interfere with the use of the Services by any other user. Gap Inc. may restrict or terminate your use of the Services for any reason.

Links and Connectivity to Other Web Sites and Services

The Services may contain links or allow you to connect to other web sites or services that are not under the control of Gap Inc. Gap Inc. has no responsibility for other web sites or services nor does linking or providing internet connectivity constitute an endorsement of any other web site or service. Gap may elect to block certain websites or online services for any reason, but has no obligation to do so. You agree to comply with the terms of use for any website or service you visit using the Services.


The Services are provided "as is" without warranties of any kind, either express or implied, including without limitation, warranties of title, implied warranties of merchantability, fitness for a particular purpose, quality, availability or security of the Services, or non-infringement of intellectual property. Gap Inc. expressly disclaims any duty to update or revise the Services, although Gap Inc. may modify the Services at any time without notice. Your use of the Services is at your sole risk, and you assume full responsibility for any costs associated with your use of the Services. Gap Inc. shall not be liable for any damages of any kind related to your use of the Services including without limitation, any damage to hardware, software or lost productivity as it relates to the use of the Services or technical assistance given by Gap Inc. staff to gain access to the Internet.


You agree to defend, indemnify and hold Gap Inc. harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the Services and/or your breach of any representation, warranty, or other provision of the Agreement.

Dispute Resolution

Mindful of the high cost of litigation, not only in dollars but also in time and energy, both you and Gap Inc. agree to the following dispute resolution procedure: In the event of any controversy, claim, action or dispute arising out of or related to any transaction conducted on the Services, or the breach, enforcement, interpretation, or validity of this Agreement or any part of it ("Dispute"), the party asserting the Dispute shall first try in good faith to settle such Dispute by providing written notice to the other party (by first class or registered mail) describing the facts and circumstances (including any relevant documentation) of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute. Notice shall be sent

  1. to Gap Inc. at: Gap Inc. Legal Department, 2 Folsom Street, San Francisco, CA 94105, Attn: General Counsel, or
  2. to you at: your last-used billing address or the billing and/or shipping address in your online profile.

Both you and Gap Inc. agree that this dispute resolution procedure is a condition precedent which must be satisfied prior to initiating any litigation or filing any claim against the other party.

Choice of Law

This Agreement shall be construed in accordance with the laws of the State of California, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and/or federal courts of the State of California, County of San Francisco and/or the Northern District of California. The waiver of any provision of the Agreement shall not be considered a waiver of any other provision or of Gap Inc.'s right to require strict observance of each of the terms herein. If any provision of the Agreement is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between us relating to your use of the Services.


These terms are effective unless and until terminated by either you or Gap Inc. You may terminate this Agreement at any time. Gap Inc. also may terminate this Agreement at any time without notice, and accordingly may deny you access to the Services, if in our sole judgment you fail to comply with any term or provision of the Agreement. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Agreement for all purposes.

Does Gap Inc. share my information?

In addition, if you choose to participate in any third-party scrip, loyalty, or similar program in which a Gap Inc. brand is a participating vendor, and you authorize Gap Inc. or our credit card processor to provide information about your purchases to the company administering the program, we will share your personal information with that program. Scrip programs allow you to instruct us to divert a percentage of the amount you spend on Gap Inc. purchases to participating schools and other non-profit organizations. Loyalty programs allow you to earn "points" on purchases at Gap Inc. brands, which you may then use toward certain rewards offered by the loyalty programs in which you participate. The information you authorize us to disclose to the third-party scrip or loyalty program may include your credit card number and the date and amount of your purchase, and may also include your name and other information you have asked us to provide. Please note that once we disclose this information, the scrip or loyalty company may use and share it with others in accordance with its own privacy policy. You should review these policies carefully, as we have no control over them.

In the unlikely event of a sale or merger of Gap Inc. or any of our businesses, our customers' personal information and other information we have collected as described in this policy may be among the transferred business assets.

If you ask us to remove your name and address from promotional lists, we will maintain your name in a "do not contact" file to ensure that we can honor your request. It may take up to 10 days to process your email request and 6-8 weeks to process your postal mail request, during which period you may continue to receive communications from Gap Inc.

If you change your mind, you can start receiving promotional communications from us again by logging into your online account and changing your preferences, by signing up when you visit our websites or our stores or when you enter a sweepstakes or contest, or by contacting customer service.

If you no longer wish to receive Athleta catalogs or wish to alert us to duplicate mailings, please contact Athleta customer service as described in the section entitled, "How do I contact you?", below. It may take up to 90 days in order for your information to be completely removed from our list.

I received a suspicious email from a Gap Inc. brand regarding an order I did not place. What should I do?

We are aware of phony emails sent out under our brand names. These emails did not originate from Gap Inc., and individuals who received fraudulent order status emails have not been charged. For your protection, do not click links or open any files attached to suspicious, unsolicited emails. If you believe your personal computer has been compromised as a result of the scam, please consult an IT professional. No. Gap Inc. does not ask prospective job applicants for information about their bank accounts, credit history or passwords to financial accounts. If you are asked for personal financial or security information in response to a job application, this is likely a fraudulent job listing hosted by spammers posing as Gap Inc. to mislead job applicants. Spammers also create phony aliases such as thegap-usa.com to mimic our company and/or brand names in an effort to commit identity theft or other forms of fraud.
